These are the Official Giveaway Rules (“Official Giveaway Rules”) for the January 2023 Giveaway (“Giveaway”) presented by Bubble Bud Inc. (“Bubble Bud”).
These Official Giveaway Rules govern the Giveaway and all Giveaway prizes, regardless of whether Bubble Bud awards such prizes. Bubble Bud is the sole sponsor and administrator of the Giveaway, which is in no way sponsored, endorsed, or administered by, or associated, with any third parties or social media platforms, including but not limited to Instagram, Facebook, or Twitter.
By participating, entrants acknowledge that Instagram, Facebook, and Twitter (or any other third party or social media platform) bear no responsibility for this promotion and no liability whatsoever in connection with the Giveaway. Any questions, comments, or complaints regarding the Giveaway must be directed to Bubble Bud directly.
No purchase is necessary to enter or win the Giveaway and a purchase does not improve the entrant’s chance of winning. By participating, entrants fully and unconditionally agree to comply with and abide by these Official Giveaway Rules and the decisions of Bubble Bud. This giveaway is void where prohibited by law.
Entry Period: The Giveaway is scheduled to begin on January 10th, 2023 at 10 A.M. Mountain Time (“MST”) and end on January 16th, 2023, at 11:59 P.M. MST (the “End Date”).
Eligibility: The Giveaway is only open to legal residents of Canada (excluding Quebec) who have reached, in the province or territory in which they reside, the age of majority at the time of entry and the minimum age for purchasing and consuming cannabis. Employees of Bubble Bud, its parents, subsidiaries, affiliates, suppliers, and agencies, and their immediate family members and persons living in their household are not eligible to enter the Giveaway. The Giveaway is subject to all applicable Canadian federal, provincial, and local laws and regulations.
How to Enter: To enter the Giveaway, entrants must: like the post, follow @DrinkZele, and tag a friend. One entry per person.
Prize: One (1) winner will be selected from all eligible entries. The winner will receive one (1) $500 Visa Gift Card. The Prize will be distributed within ten (10) days after the winner has been successfully contacted, notified and has fulfilled the requirements set out herein. The shipped Prize will not be insured and Bubble Bud does not assume any liability for lost, damaged, nor misdirected prizes. The Prize is not transferable, assignable, nor redeemable for cash. Any applicable federal, provincial, and local tax liabilities are the responsibility of the winner.
Winner Selection: One (1) entrant will be selected at random from all eligible entries received by the Giveaway End Date. The odds of being selected depend on how many eligible entries have been received.
Winner Notification: The selected entrant will be notified via email/social platform from Bubble Bud that they are the potential winner (the “Prize Notification”). Bubble Bud will provide an email address (or other contact information) where the selected entrant may make a Prize claim. To qualify to receive the Prize, the selected entrant must respond to such Prize Notification within three (3) business days of the sending by Bubble Bud of the Prize Notification, providing Bubble Bud with full contact details and proof of age, as will be indicated in the notification. Acceptable proof of age will be a photo of one piece of valid photo identification issued by a Canadian federal, provincial, or territorial government displaying the entrant’s full legal name and date of birth.
Skill-Testing Question: Within the same period of three (3) business days from the time the Prize Notification is sent, selected entrants will also be required to answer an unaided mathematical skill-testing question which will be included in the Prize Notification.
Failure by Selected Entrant to Respond: Failure to respond to the Prize Notification and to provide all required information, including acceptable proof of age within three (3) business days, and to comply with the other provisions of the Giveaway may result in the selected entrant being disqualified and an alternate winner being selected. If a Prize Notification or a Prize is returned as undeliverable for any reason, the Prize will be awarded to an alternate winner. Bubble Bud is entitled to disqualify any selected entrant who does not meet all the conditions stipulated in these rules and its decision in that regard is final.
General Refusal by Winner to Accept Prize: A refusal by a winner to accept the Prize as awarded and in its entirety releases and forever discharges Bubble Bud from any and all obligations to the winner.
General Release: By participating in the Giveaway, each entrant agrees to hold Bubble Bud and its parent company(ies), subsidiaries, affiliates, franchisees, successors, assigns, advertising, promotion and public relations agencies, service agencies, and independent contractors, and all of those entities’ respective directors, officers, employees, representatives, and agents from and against any and all liability for any and all costs, injuries, losses or damages of any kind, including, without limitation, death and injury and property loss or damage, due in whole or in part, directly or indirectly, to participation in the Giveaway, or arising out of participation in any Giveaway-related activity, or due or related to the receipt, use or misuse of the whole or any part of any prize or prize-related activity (including any travel or activity related thereto), or the use by Bubble Bud or its designees of any entry or component thereof. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, ON THE PART OF ALL RELEASEES. RELEASEES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT.
Limitation of Liability: Bubble Bud assumes no liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies, or any declaration and release, or for any computer, online, software, telephone, hardware, or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. Bubble Bud is not liable for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the administration of the Giveaway. Bubble Bud assumes no liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, entries. Bubble Bud is not responsible for any injury or damage to the entrant or to any computer related to or resulting from participating or downloading materials in the Giveaway. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Giveaway, or by the acceptance, possession, use of, or failure to receive any Prize.
Interruption or Force Majeure: Bubble Bud assumes no liability in the event that Bubble Bud is prevented from continuing the Giveaway for any reason beyond the control of Bubble Bud including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity, or proper conduct of the Giveaway, or any federal, provincial, or local government law, order or regulation, or order of any court or jurisdiction.
False or Misleading Information: Any entry, declaration, and release or any other document required by Bubble Bud for any reason that is incomplete, altered, or contains false or misleading information shall be invalid and the person who submits such entry or document will be disqualified from the Giveaway.
Collection and Use of Personal Information: Personal information will only be collected, used, and disclosed by Bubble Bud and its respective designees for the purpose of administering the Giveaway in accordance with these Official Giveaway Rules and the Bubble Bud Privacy Policy.
Governing Law and Jurisdiction: Any dispute arising from this Giveaway will be determined according to the laws of the Province of Alberta, including the procedural provisions of those laws, without giving effect to any choice of law or conflict of law rules. All entrants agree to consent to the exclusive jurisdiction of the courts of Alberta, sitting in Edmonton, Alberta, for the determination of any matter or dispute arising under or in respect of the Giveaway.
